If your spouse is a U.S. citizen and you’re already in the U.S. on a valid status, expect 10–14 months for the green card. Consular processing abroad varies by country

Do we need to be married before I can file?

For a CR1/IR1 spouse petition, yes. If you’re engaged and your fiancé is abroad, we file a K-1 fiancé visa first, then adjust status after marriage in the U.S.

What if I overstayed my visa?

If you’re married to a U.S. citizen and entered legally, overstay generally doesn’t block adjustment of status. Don’t leave the country before we evaluate your case.
