Who qualifies for SIJS?

Unmarried immigrants under 21 in the U.S. who have been abused, neglected, or abandoned by one or both parents, and for whom return to their home country is not in their best interest.

Do I need a state court order first?

Yes. SIJS requires a predicate order from a New York family court making specific findings about abuse, neglect, or abandonment. We coordinate the entire process — family court + USCIS.

What’s the age cutoff?

You must apply for the state court order before turning 21 in New York. The earlier you start, the better — backlogs are real.

Does SIJS lead to a green card?

Yes. Once USCIS approves your SIJS petition, you can apply for a green card (subject to visa bulletin priority dates for some countries).

Will my parents be notified?

Family court has procedures to protect children. We handle these cases carefully and confidentially.

Can I work while my case is pending?

After your I-485 adjustment of status is filed, you can apply for a work permit.
